Terms and Conditions

1. Overview

These Terms and Conditions govern your use of the Boostd website and mobile applications (“Site”), your participation in fitness classes or use of services in our studios (“Studios”), and any purchases of products or services (“Products” or “Services”) from Boostd AG.

By accessing or using the Site, attending classes, or purchasing any Services or Products, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or our Services.

2. Definitions

• “Boostd” refers to the trade name of Boostd AG.
• “Member” means any person who has completed the registration process online or signed a waiver in the Studio.
• “Services” includes fitness classes, online content, and all services offered at our Studios or through the Site.
• “Products” means any merchandise sold via the Site or in our Studios.
• “Site” refers to www.boostd.life and any successor sites.

These Terms and Conditions apply to all interactions between you and Boostd and are incorporated into the Member Registration Form.

3. Booking, Cancellation, and Waitlists

3.1 Eligibility

Participants must be 18 years or older, or have written parental/guardian consent.

3.2 Booking and Attendance

• All classes must be prepaid and are subject to availability.
• Bookings can be made via our Site or mobile app.
• Members must cancel or reschedule at least 3 hours before class start time to avoid penalties.
• Late cancellations (within 3 hours) result in:
• For single-class/package users: forfeiture of the class credit.
• For “All You Can Boost” members: a CHF 25 late cancellation fee.
• Members are entitled to one “grace cancellation” (joker) per calendar year, which allows a class credit to be restored or the CHF 25 fee waived. You will be notified by email if this has been used.
• No-shows (failing to attend without canceling) are not eligible for the grace cancellation.

3.3 Waitlist Policy

• Waitlists are processed automatically up to 12 hours before the class.
• If a spot opens, Members will be automatically added in order of registration and notified by email or push notification.
• If a spot opens less than 12 hours before class time, no automatic enrollment occurs, but Members on the waitlist will be notified and can book on a first-come, first-served basis.

3.4 Studio Conduct

Boostd reserves the right to refuse service, suspend, or expel any Member whose behavior is inappropriate or disruptive, without refund.

4. Payment Terms

• Class prices and packages are listed on our Site and are subject to change.
• All payments are non-refundable, except in limited cases (e.g., documented medical reasons or errors attributed to Boostd).
• Extensions to package validity may be granted for illness or injury upon submission of a medical certificate.

5. Health and Fitness Policy

• By joining a class, Members confirm they are in good health and medically fit to participate.
• Members are responsible for informing Boostd of any medical conditions or injuries.
• Pregnant participants must:
• Notify Boostd at hello@boostd.life
• Follow the instructions provided by Boostd, and the instructors during classes
• Discontinue participation four weeks before the due date
• Postpartum training is permitted only after obtaining a doctor’s approval.
• Our instructors are not medical professionals. We strongly recommend consulting a doctor before starting any exercise program.

6. Safety, Dress Code, and Hygiene

• Wear appropriate gym attire. Toe socks with grip are recommended.
• No footwear is allowed in training areas.
• Personal belongings should be stored in designated areas; Boostd is not liable for loss or damage.
• No glassware, crockery, or food is allowed in Studios.
• Do not tamper with fire exits. In case of emergency, follow posted exit instructions.

7. Referral Program

Boostd offers a Referral Program via the mobile app:

• Invite friends using your referral code.
• Your friend receives CHF 20 off their trial class.
• After your friend’s second visit, you receive one free class credit.
• This benefit applies only to first-time clients.
• Boostd may amend or terminate the Referral Program at any time with reasonable notice.

8. Liability Disclaimer

• Boostd is not responsible for unavailable instructors, sessions, or equipment.
• Boostd may change schedules or instructors at its discretion without compensation.
• Participation is at your own risk. Members accept full responsibility for their health and safety.
• Boostd excludes all liability for injuries, losses, or damages unless legally non-excludable.
• You agree not to sue Boostd, its employees, or instructors for injuries sustained during participation.
• Boostd is not liable for loss or theft of valuables. Lockers are used at your own risk.

9. Warranties

Boostd warrants that Services and Products will be delivered with reasonable care and skill. No further warranties apply beyond those required by law.

10. Intellectual Property & Site Use

• All content on the Site, including text, graphics, and logos, is the property of Boostd AG or its licensors.
• You may use the Site for personal, non-commercial purposes only.
• You may not copy, distribute, or exploit content without written permission.
• “Boostd” is a registered trademark of Boostd AG and may not be used without license.

You must not post unlawful, defamatory, or harmful material on our Site or social media platforms.

11. Privacy

By using the Site and Services, you agree to our Privacy Policy, which complies with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR).

12. Governing Law & Jurisdiction

These Terms and Conditions are governed by Swiss law. Any disputes shall be resolved in the courts of Zürich, Switzerland.

13. Updates

Boostd may revise these Terms and Conditions at any time. The current version will always be available on the Site. Continued use of the Site or Services implies acceptance of the updated terms.
